Fired teacher must be paid, allowed to return to work

Circuit Judge Sam Pope issued a judgment Thursday ordering the Warren School District to pay Col. Robert Avery nearly $202,000 in back-pay and make arrangements for him to return to work within 10 days.

The Warren School District’s action in terminating Avery is void and, consequently, Avery remains employed by the Warren School District and is entitled to all compenstation and benefits, according to Pope’s judgment and order.

Within 10 days of the filing of the judgment & order, the Warren School District must make arrangements for Avery to return to work as director of the school’s JROTC program and must resume payment of his salary and benefits, including all back-pay which is calculated to be $201,965.92.
