The Kathy Livingston capital murder trial has been set for early September in Ashley County. Livingston, of Lake Village, is alleged to have fatally shot her 58-year-old husband Bobby Livingston last summer.
Venue for the trial was moved in February from Chicot County to Ashley County. Circuit Judge Sam Pope granted a defense motion to move the trial to Ashley County because it is believed that it would be difficult to pick a jury in Chicot County.
“Given the fact that the victim’s family is very well known and well- liked in Chicot County it would be difficult to pick a jury of 12 so the judge ordered the case transferred to Ashley County,” 10th Judicial District Prosecutor Thomas Deen said in a February interview.
Bobby Livingston, president of Livingston Pecan and Metal, died of a gunshot wound on June 18, 2011. Kathy Livingston survived a self-inflicted gunshot wound to the chest.
Through her attorneys she has also filed a motion to suppress certain evidence in the case. Pope said he will take the motion under advisement and set the trial date for early September.
Livingston previously filed a notice of mental defect but a state mental examination determined that she is fit to stand trial, according to Dr. Myeong Kim’s report.
Its about time that justice is served. Bobby was a great man who was taken way too early. I do hope that she is punished to the fullest extent of the law. Her crime is the definition of cold blooded murder.
This whole situation is terrible. This is my mother and I love her but do not condone her actions. However no one knows what led up to this and shouldn’t just automatically assume it was unprovoked.
You must not walk with GOD for he is the only one to judge. It is a sin to judge someone. Did you live in the house? Just because you know the persons involved, does not let you see behind close doors.
