The capital murder trial for a Lake Village woman charged in the 2011 shooting death of her husband has been moved to Ashley County.

Following a telephone conference call Tuesday with Kathy Livingston’s defense attorneys and 10th Judicial District Prosecutor Thomas Deen, Circuit Judge Sam Pope granted a defense motion for a change of venue. Deen did not object.

Livingston is alleged to have fatally shot her 58-year-old husband Bobby Livingston.

“Given the fact that the victim’s family is very well-known and well liked in Chicot County it would be difficult to pick a jury of 12 so the judge ordered the case transferred to Ashley County,” Deen said.

Bobby Livingston, president of Livingston Pecan and Metal, Inc. died at 6:30 p.m. on June 18 of a gunshot wound to the chest. Kathy Livingston survived a self-inflicted gunshot wound to the chest.

Kathy Livingston last month filed a notice of mental defect but a state mental examination determined that she is fit to stand trial, according to Dr. Myeong Kim’s report.

A trial date has not yet been set.
