Kathy Livingston, 58, has filed a motion to have her $1 million bond reduced. A hearing of her motion has been set for September 15 at the Chicot County Courthouse at 9 a.m. before Circuit Judge Sam Pope.

Livingston is alleged to have fatally shot her husband then shot herself.

Tenth Judicial District Prosecutor Thomas Deen said he will not seek the death penalty because there is not sufficient evidence of the aggravating circumstances that are required by law to seek the death penalty.
